But the NBA can't ban any player for his personal behavior prior to joining the league -that's why players with actual criminal records prior to the draft can still join

Even if he did call him a n*****, you can't have basketball players pushing fans. If it was the fan pushing the basketball player, he would've been arrested. Smart's lucky he's not been arrested. Three game suspension is getting off easy. The fan could be the biggest asshole in the world, but it doesn't matter.
