Trump, should he pursue the executive order, would face court challenges, and it remains unclear whether he could prevail. Many legal scholars would argue such a change requires a constitutional amendment. But some conservatives argue the existing amendment holds room for interpretation.

But again... I'm not certain if they're reliable or merely fake news either. They did call out Trump on a lie earlier in the article.
Don't get me wrong - entirely possible the Supreme Court rules against it. But then we'll at least have a decision on record. SCOTUS has never ruled on birthright for illegals. If they decide that the 14th Amendment secures birthright, then a new amendment would be the only way.

Or the new interpretation that it does not secure birthright?

Well that would become the new precedent then. I'm not sure if they'd want new law to accompany it as well.

Well ending birthright was always one of the last steps. There are some other things that should be done first:

(1) Ending chain migration
(2) Mandatory E-Verify
(3) Legislation penalizing employers for hiring illegals

Then it's figuring out what to do with the illegals here. I say give them permanent non-resident status, and gradually introduce them to the population while lowering the legal immigration quotas in the interim. They can have a path to citizenship if they go to the back of the line behind those who waited their turn.

Riley, your post doesn't mean what you think it does, friend. The 14th Amendment was to make slaves and the citizens of slaves citizens. That's why the authors went out of their way to make clear that it did not apply to children of foreigners born here.

To further make this point clear, note that the 14th Amendment did not grant citizenship to Native Americans. The Indian Citizenship Act (1924) did so.

Thank you for making our case for us.
Again, this is simply your opinion...The Constitution says what it says...So far, the constitution, and my opinion are consistent, and that is what we have adhered to for centuries...

Number 2 and number 3 on your list would be the most effective way...

Americans are knowingly hiring illegal immigrants...If we throw these fuckers in jail and/or shut down their businesses, Illegal immigrants would no longer have the same incentives to jump the border.

There is no precedent. It's never been challenged in the Supreme Court with regards to an illegal. Only with regards to a child of legal permanent residents (when it was at odds with the Chinese Exclusion Act).

So the precedent is sorta that they are granted citizenship?

And that challenging it in court is actually a new development/precedent/interpretation?

Can you point me to U.S. policy on illegal immigration in the 1860's?

Sure. The law of the land prior to the 14th Amendment was the Naturalization Law of 1802:
The 1802 act replaced the Naturalization Act of 1798, and provided:

The "free white" requirement remained in place
The alien had to declare, at least three years in advance, his intent to become a U.S. citizen.
The previous 14-year residency requirement was reduced to 5 years.
Resident children of naturalized citizens were to be considered citizens
Children born abroad of US citizens were to be considered citizens
Former British soldiers during the "late war" were barred unless the state legislature made an exception for them
The Naturalization Act of 1798 of course, was one of the Alien and Sedition Acts, and allowed any free white men from non-hostile nations to become naturalized citizens after a waiting period of 14 years.
