Brad Boley, 61, is facing an animal cruelty charge for putting the 2-month-old Chihuahua named Buddy in a kennel and then placing the kennel on the stove.
It happened in February of 2014 at the Boley’s condo on Bowser Avenue. A neighbor testified she heard piercing screaming sounds and crying that lasted almost five minutes.
Another neighbor, Jarod Foote, described hearing similar cries as he was parking his car. He followed the sound and then banged on the door because he saw smoke through a mail slot.
Foote said he convinced Boley to take the little dog to the vet.
“He was whimpering the whole time. He kept looking up at me and I would comfort him and kiss him and pet him to try to make him feel as comfortable as I could because I know that he was in severe pain,” he said.
Jurors were shown pictures of Buddy’s injuries, including some that showed melted plastic on his body. The little dog suffered third-degree burns and had to be put to sleep.
Pictures of the dog kennel and the defendant’s statement to police will not be presented to the jury because defense attorneys argued the kennel was taken without a search warrant and Boley did not receive proper Miranda rights.
The defense also pointed out that according to the vet records Boley was distraught and agree to euthanize Buddy because he did not want him to suffer.
